2. Which data are collected and how are they used?
2.1 Data collection by this website
Each time a user accesses the website, the user's Internet browser automatically transmits the following data to the imc web server for technical reasons:
- IP address of the requesting computer
- Date and time of access
- Name and URL of the retrieved file
- Transferred amount of data
- Access status (file transferred, file not found, etc.)
- Recognition data of the browser and operating system used
- Name of the provider of the Internet access of the user
- Web page from which access is made
These data are collected, processed and used for the purpose of enabling the use of the website (connection setup), system security and technical administration of the network infrastructure. A comparison with other databases or a transfer to third parties, even in extracts, does not take place. The legal basis for the processing is Art. 6 para. 1 b GDPR.
2.2 Use of Piwik Pro
This website uses the Consent Management Tool of Piwik PRO Analytics Suite ("Piwik PRO") of the company Piwik PRO GmbH, Kurfürstendamm 21 - 10719 Berlin, see piwik.pro.
This software is used to collect data for the needs-based design of our website and for statistical analysis of visitor flows for marketing and optimization purposes. In the process, pseudonymous usage profiles are also created. For this purpose, cookies are used which are stored on your computer and which enable a pseudonymous analysis of your use of our website. The IP address is shortened immediately after collection and before it is stored. Piwik PRO always analyzes the use of our website anonymously. 2.3 LinkedIn Insight Tag
Our website uses the conversion tool "LinkedIn Insight Tag" from LinkedIn Ireland Unlimited Company. This tool creates a cookie in your web browser, which enables the collection of the following data, among others: IP address, device and browser properties, and page events (e.g. page views). This data is encrypted, anonymized within seven days, and the anonymized data is deleted within 90 days. LinkedIn does not share personal data with imc, but offers anonymized reports on website audience and ad performance. 2.4 Use of Mouseflow
Our website uses Mouseflow, a web analytics tool provided by Mouseflow ApS, Flaesketorvet 68, 1711 Copenhagen, Denmark. Data processing is for the purpose of analyzing this website and its visitors. For this purpose, data is collected for marketing and optimization purposes and stored within the EU. From this data, usage profiles can be created under a pseudonym. Cookies can be used for this purpose. With the web analysis tool Mouseflow, randomly selected individual visits (only with anonymized IP address) are recorded. This creates a log of mouse movements and clicks with the intention of randomly replaying individual website visits and deriving potential improvements for the website. Google AdWords
Our website uses Google Conversion Tracking. If you have reached our website via an ad placed by Google, a cookie is placed on your computer by Google AdWords. The conversion tracking cookie is set when a user clicks on an ad placed by Google. These cookies expire after 30 days and are not personally identifiable. If the user visits certain pages of our website and the cookie has not expired, we and Google may recognize that the user clicked on the ad and was directed to that page. Each Google AdWords customer receives a different cookie. As a result, cookies cannot be tracked through the websites of AdWords customers. The information collected from the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. Customers will know the total number of users who clicked on their ad and were directed to a page tagged with a conversion tracking tag. However, they do not receive information that personally identifies users.

Embedded YouTube videos
On some of our websites we embed YouTube videos. YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA, is the operator of the corresponding plug-ins. When you visit a page with the YouTube plugin, a connection is established to YouTube servers. This will tell YouTube which pages you are visiting. If you are logged in to your YouTube account, YouTube can personally assign your surfing behavior to you. You can prevent this by logging out of your YouTube account beforehand.
If a YouTube video is started, the provider uses cookies that collect information about user behavior.
If you have deactivated the storage of cookies for the Google Ad Program, you will not have to contend with such cookies when watching YouTube videos. Pardot Marketing Automation
Pardot is a software for marketing automation. Marketing automation helps us to find out the product interest of our users, to improve the information offered on our website and to provide users with more relevant information.
imc Test & Measurement GmbH uses Pardot as a marketing analysis service that enables us to maintain, measure and optimize communication with our website visitors. Based on the findings of the analysis, we can continuously optimize the website content.
When you visit our website, Pardot Marketing Automation records your click path and creates an individual user profile using a pseudonym. Cookies are used for this purpose to enable us to recognize your browser. By confirming the cookie acceptance banner, you consent to the use of Pardot cookies. You can revoke your consent at any time with effect for the future. imc Test & Measurement GmbH only stores personal data of visitors to the website who request information or offers on products and services that have been registered on our websites and/or who have registered to receive the newsletter. Voluntarily provided and transmitted personal data are first stored in Pardot and then processed with the Salesforce CRM system for the purpose of contacting and/or sending information. The legal basis for data processing using Paradot Marketing Automation is Art. 6 Para. 1 f DSGVO, whereby imc's authorization results from the fact that imc has an interest in evaluating the usage data of the website in order to further improve its own offer and the website and to adapt it to the customers. Furthermore, the persons concerned can reasonably foresee that their personal data will be processed accordingly by imc.
4. Are other personal data collected and processed?
We only collect and process your personal data if you call up certain services (e.g., with regard to the download of software or information relating to the transfer of data) and we need your data for this purpose, or if you have voluntarily given us your express consent to do so. Data processing within the scope of registration
In addition, you have the option of registering on our website, stating your personal data. In addition to the personal data provided, the date and time are also recorded during registration.

5. Will my data be passed on to third parties, e.g., to authorities?

In certain cases, we are legally obliged to transmit data to a requesting government agency.
Upon submission of a court order, we are obliged pursuant to § 101 of the German Copyright Act (Urheberrechtsgesetz) to provide holders of copyrights and ancillary copyrights with information about customers who are alleged to have offered copyrighted works in Internet file-sharing networks. In these cases, our information contains the user ID of an IP address allocated at the time requested and, if known, the name and address of the customer.
Otherwise, personal data will only be transferred to state institutions and authorities within the framework of mandatory national legal provisions or if the transfer is necessary in the event of attacks on the network infrastructure for legal or criminal prosecution. The legal basis for the processing is Art. 6 Para. 1 c GDPR or § 24 Para. 2 No. 1 BDSG.
To external service providers for data processing:
When service providers come into contact with the personal data of our customers, this is usually done as part of a so-called order processing of personal data. This is expressly provided for by law. imc remains responsible for the protection of your data in this case as well – possibly in addition to the order processor. The service provider works exclusively in accordance with our instructions, which we ensure through strict contractual regulations, technical and organizational measures and supplementary controls.
imc uses service providers as order processors. These are imc Group companies and service providers within the IT service categories (e.g., for technical-administrative tasks and for usage analysis), telecommunications, consulting as well as sales and marketing.
imc complies with the data protection regulations regarding the processing of personal data in accordance with instructions.
In imc Group companies:>imc may transfer your personal data to imc Group companies and their affiliated sales and service partners (see: https://www.www.imc-tm.com/our-partners/imc-worldwide/) in order to carry out a possibly existing business relationship with you or to safeguard legitimate interests. In addition, intra-group data transfers may take place due to order processing in accordance with Art. 28 GDPR.
If data is transferred abroad, it is located within the EU or the European Economic Area or in a country that has an adequate level of data protection in accordance with the EU Commission's decision. In the case of data transfers to imc Group companies located in other countries, imc guarantees that the imc Group companies importing the data are obliged to maintain an appropriate level of data protection.
Beyond that, we do not pass on any data to third parties unless you have expressly consented, the transfer is clearly necessary for the execution of an offer or service requested by you or this is provided for by law. We also do not intend to transfer your data to a third country or an international organization.
6. How long will my data be stored?
We store data for as long as it is necessary to provide the service you have requested or as long as it has been specified in a corresponding consent. In addition, the personal data collected are stored – insofar as they are subject to retention – until the end of the statutory retention period for merchants (6, 8 or 10 years after the end of the calendar year in which the contractual relationship was terminated) and then deleted. This does not apply, as an exception, if we are obliged to store data for a longer period of time due to tax or commercial law storage obligations (according to German Commercial Code or Tax Law).
If your data is not required to be stored by law, it will be deleted after expiry of the limitation period for contractual claims of a maximum of 3 years.
IP addresses are anonymized at regular intervals of 7 calendar days.

You can request information about the scope, origin and recipients of the stored data as well as the purpose of the storage at any time and free of charge.
You also have the right to correct, delete or restrict the processing of your data, a right of objection to the processing and a right to data transfer in accordance with data protection regulations.
Reference is made to the existence of a right of appeal with a supervisory authority.
